e.SOL Terms of Service

1. Who we are

e.SOL is operated by [e.SOL legal company name], [registered address] ("e.SOL", "we", "us"). e.SOL is an online service that helps people run rotating savings groups, also called sòl, sou-sou, san or tontine, in which every member contributes a fixed amount each cycle and one member receives the whole pot in turn.

2. Accepting these terms

By creating an account or using e.SOL, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use e.SOL. You must be at least 18 years old and able to enter into a binding contract where you live.

3. Your account

Give true, current information, and keep your email address and phone number up to date.
Keep your password private. You are responsible for what happens under your account. For your safety, e.SOL signs you out after a short time without activity and allows one signed-in device at a time.
Tell us right away at the support address below if you think someone else has used your account.

4. Savings groups

Group owner and co-admins. The member who creates a group is its owner. The owner, and the co-admins the owner chooses, invite people, approve or decline join requests, set the payout order, write the group's terms, and can pause or remove members.
Group terms. Each group has its own terms, which every member signs electronically when asking to join. Your typed name, the date, time, your IP address and the version of the terms are kept as your signature. Group terms are an agreement among the group's members; they must not conflict with these Terms of Service.
Your commitment. By joining a group you commit to pay your contribution on time in every cycle, including after you have received the pot. Missing payments harms the other members.
Privacy inside a group. Regular members see the group's totals and their own payments and turn. They do not see other members' names or contact details. The group owner and co-admins see the details of their group's members so they can run the group.

5. Money

[Until online payments launch:] Members pay each other outside e.SOL, for example in cash, by Zelle or by bank transfer. e.SOL records the payments and payouts that group admins and the e.SOL team enter, and sends reminders and statements. e.SOL does not hold, receive or transfer members' money.
[When online payments launch:] Card and bank payments are processed by our payment partner [Stripe], under its own terms. [Describe how funds flow, when the pot is paid out, fees, refunds and chargebacks, as approved by counsel.]
e.SOL is not a bank, does not pay interest, and does not guarantee that any member will pay. [Confirm with counsel which money-transmission rules apply and adjust this section.]

6. Free trial and plans

Each new group starts with a free trial ([15] days). After the trial, the group owner can keep the group growing by paying for a plan at the price shown on the group's Plan page. A cycle that has started is never interrupted because of the plan: if a plan is not paid, the group may stop accepting new members until it is. [Add billing period, renewal, cancellation and refund terms.]

7. Identity checks

To protect members, group admins are asked to send a valid identity document to e.SOL. Only the e.SOL team can see it. We may decline or remove access for anyone whose identity we cannot confirm.

8. Messages and conduct

You may use e.SOL's messages only to communicate about your groups. Do not send anything illegal, abusive, fraudulent or misleading, do not collect other members' data, and do not try to break or overload the service. We may remove content and suspend or close accounts that break these rules.

9. Text messages and email

We send service emails, such as confirmations, payment reminders, monthly statements and messages from your group. If you switch on text messages, we send reminders and announcements to your phone; message and data rates may apply, and you can switch them off at any time in your settings.

10. Ending your use of e.SOL

You can stop using e.SOL at any time by contacting support. If you are in a group with open cycles, you remain responsible to the group's members under the group's terms. We may suspend or close an account that breaks these terms, and we will give notice when the law requires it.

11. Disclaimers and limits of liability

e.SOL is provided "as is". We work to keep it available and accurate but cannot promise it will always be free of interruptions or errors. To the extent the law allows, e.SOL is not liable for losses caused by members who do not pay, for indirect or consequential losses, or for more than [the amount you paid e.SOL in the 12 months before the claim]. 12. Changes to these terms

We may update these terms. When we make an important change, we will ask you to accept the new version the next time you sign in.
